Subsys is a medication that is 100 times more potent than morphine. It is a fentanyl-based opioid mouth spray intended to treat cancer patients suffering intense episodes of breakthrough cancer pain. Subsys should not be prescribed to patients who do not have cancer, but we have found there are many doctors prescribing it to patients off-label, who do not have cancer.

The drug’s manufacturer, Insys Therapeutics, Inc., is currently being investigated by the FBI and the Department of Justice for allegations that it bribed doctors to unnecessarily prescribe Subsys to patients who did not have cancer. Details about the FBI’s investigation can be found here.
On December 8, 2016 the Department of Justice arrested six of Insys’ top former corporate executives, including Insys’ former CEO and President, on charges and allegations that they led a nationwide conspiracy to bribe doctors to unnecessarily prescribe Subsys off-label to patients who did not have cancer. According to the DOJ’s charges, Insys may have also tricked insurance companies into paying for Subsys by claiming that patients had cancer when, in fact, they did not. According to the charges, doctors who participated in the scheme were paid large amounts of money, some earning more than one hundred thousand dollars.
